Rail Authority sets September deadline for right-of-way violations
July 19th, 2006The Minnesota Valley Regional Rail Authority recently set September deadlines for two Arlington property owners to vacate their use of the railroad right-of-way.
The Rail Authority notified Jeff Wilken of Arlington and the City of Arlington that they have until September 30 to correct the situation of a driveway in the railroad right-of-way.
The City of Arlington had issued the previous owner a permit to install a driveway. According to the Rail Authority, the previous owner started driving in the railroad right-of-way, and the city should have followed up and enforced the permit. It is the Rail Authority’s opinion that the city needs to rectify the situation with Wilken. Wilken will need a curb cut for a driveway to access his garage.
Cemstone Products Co. in Arlington was given a September 1 deadline to vacate the Rail Authority’s right-of-way. The Rail Authority authorized chairman Bruce Pinske to talk to them about the matter.
Rail Authority Attorney Dave Schauer informed the Rail Authority that he will notify Darin Schultz that he can no longer park his truck in the right-of-way of the track every night between Main Street and Adams between the track and the spur.
